NYPD says, "Let em smoke."

The New York Post is reporting that the NYPD has issued a memo to LEOs that says the smell of marijuana is no longer cause for a stop and search.

Smoking cannabis is allowed “almost anywhere that cigarette smoking is allowed including on sidewalks, on front stoops and other public places.”

Another interesting development is gifting.

UNDER THE NEW LAWS, A PERSON CANNOT BE CHARGED WITH THE SALE OF MARIHUANA UNLESS THEY RECEIVE COMPENSATION IN EXCHANGE FOR THE MARIHUANA.  THEREFORE, THE HAND TO HAND EXCHANGE OF LAWFUL AMOUNTS (3 OZ OR LESS) OF MARIHUANA, WITHOUT COMPENSATION TO A PERSON 21 OR OVER, IS NOT CONSIDERED A SALE OF MARIHUANA.
